Misconduct

Candidates are expected to:

  1. abide by the test terms and conditions, which you agreed to upon registration;
  2. always follow the instructions of the test centre supervisors or online proctors;
  3. respect the rights of test supervision staff, ACER staff, and other candidates who may be sitting the test at the same time as you; and
  4. not engage in misconduct.

Note: If you engage in misconduct in respect of any aspect of your engagement with ACER regarding your participation in the test including any of the acts listed below, you may be reported and subject to the specified SANCTIONS.

Misconduct in connection with the test includes:

  • an act, omission or communication with ACER, its staff or contracted service providers that is disruptive, offensive, aggressive or abusive whether before, during or after your test session;
  • breach of any of the security arrangements for the test;
  • impersonation;
  • attempting to copy or memorise all or part of the test;
  • failure to follow the instructions of the test supervisor or online proctor at all times;
  • using inappropriate, abusive, or aggressive communication in any form or displaying such behaviour with ACER;
  • giving or receiving assistance during the test. Communication between candidates in any form is not permitted during the test administration. Discussing or sharing of test content during the test administration or after the test is prohibited;
  • creating a disturbance or disruption to the test. Disruptive behaviour in any form will not be tolerated; the chief supervisor or online proctor has sole discretion in determining what constitutes disruptive behaviour;
  • being found with or attempting to use prohibited aids (e.g. notes, note paper, dictionary, calculator, mobile phone, smart glasses, smart watches or any device capable of audio or video recording etc);
  • using a web browser to access websites other than the test during the test session;
  • using other software, except those authorised by ACER, during the test;
  • having any other person in the test room including dependent children or animals (pets);
  • talking out loud (unless it is to ask your online proctor a question) during the test session;
  • continuing to type even after the instruction is given to stop;
  • any conduct that impinges upon the security or integrity of the test or another candidate's participation in the test;
  • tampering with a computer during the test administration;
  • leaving the test room or test centre without permission;
  • using the test questions, their content or information about them for purposes other than your sitting of the test. This includes publishing the test questions, any of their content or information about them, in any format; and/or passing the test questions, any of their content or information about them to third parties;
  • infringement of copyright. Copyright infringement includes: performing those rights or authorising the performance of those rights which are granted at law exclusively to the copyright owner. These rights include the exclusive right to reproduce the copyright work in a material form and to communicate that work to the public;
  • in any way breaching (as determined by ACER in its absolute discretion) any of the terms and conditions of your registration to participate in the test; 
  • any negligent, unlawful or wilful act or omission by you which ACER, in its absolute discretion, renders you to be unfit to participate in the test, whether or not you are registered to participate at the time of ACER’s determination;
  • forging or amending result statement or other document issued by ACER;
  • giving of false or misleading information to ACER or any other entity connected with the test; or
  • misrepresentation of your results or any other fact concerning your sitting of the test to third parties. 

Please note:

  1. any suspected misconduct will be reported by the test supervisors or online proctor to ACER;
  2. if you are found to have engaged in misconduct (including that specified above) concerning any aspect of your engagement with ACER connected with your participation in the test, you will be subject to a sanction. A sanction may include cancellation of your registration without any refund, the withholding of your test results or disqualification to sit the test in the future;
  3. if a sanction is applied:
  • the imposition of the sanction may be reported to any relevant educational institution;
  • it will be applied after the time ACER became aware of the misconduct and will not be backdated;
  • the misconduct specified above may constitute criminal offences under the Commonwealth, Victoria or your local law, for example, Section 83A of the Crimes Act 1958 (Vic), Section 144.1 of the Criminal Code Act 1995 (Cth). In which case the relevant misconduct may be reported to the appropriate law enforcement authorities for prosecution;
  • if ACER has suffered any loss, damage or expense as a result of the misconduct it may proceed for recovery under civil law; and
  • ACER does not provide any appeal process in respect of the imposition of a sanction and will not engage with any request concerning such.
